1. General

bmesgroup.com is a Building Materials Eco Solutions Marketplace website operated by Building Materials Eco Solutions Limited, a company registered in Malta with company registration number C82835 whose registered address and showroom is located 181 Triq Annibale Preca, Lija, LJA 1918, Malta, EU. All our operations, including these terms and conditions, are governed by the laws of Malta.
1.2 Acceptance of terms
By registering for an account or using this service, you hereby accept and agree to be legally bound by all of these terms. If you do not accept and agree to be bound by any of these terms, you should not register and you are not authorized to use this service.
1.3. Changes in terms and conditions
Any changes to these Terms and Conditions will be communicated to you in advance and you will have an option to not accept any changes or new rules by requesting to close your account. Your continued use of your account or this service after changes constitutes your acceptance of any changes to these terms and conditions.

This agreement is valid until further notice.
2. Exceptional circumstances
2.1 System errors and failures
You should notify us if you become aware of any errors while using our site. If you find an error and take advantage of it, we reserve the right to close your account and to seek compensation for any costs or losses to us related to the abuse. Should any system failure occur that results in an error in any charges, fees, ('system error'), we will make sure that all affected s accounts are restored to their status as they were before the system error took place.
2.2 Online Disruptions
We are not liable for any disturbance due to maintenance, downtime, server disruptions, lagging, or any technical or political disturbance or events outside of our control to online service access. We provide no warranty or guarantee as to the suitability or quality of any goods or services supplied and you acknowledge that you have the sole responsibility for the selection of them. Except as expressly provided in this agreement, all conditions, representations and warranties (expressed or implied, statutory or otherwise) are excluded to the fullest extent permitted by law including without limitation any implied warranties or conditions as to quality or fitness for purpose. We accept no liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with the website or its content; including without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person’s misuse of the site or its content or any errors or omissions in content. None of the parties shall be liable for any loss or damage caused by delay or failure to fulfil its obligations under this agreement where such delay or failure is due to any cause beyond the control of the parties, as the case may be, including (without limitation) acts of God, war or warlike action, civil disorder, insurrections or riots, fire, storm, flood, explosions, earthquakes, epidemics or quarantine restrictions, sabotage, government disorders, priorities or regulations affecting materials or facilities, court orders, restrictions as a consequence of decision or view taken by any governmental body or similar, strikes actual or threatened, labour troubles causing cessation, slowdown or interruption of work, inability to obtain necessary governmental or regulatory Authority approval, delay or cancellation of any commercial air service, or any cause to the extent it is beyond the parties' reasonable control.
3. Closing your account
We reserve the right to refuse or close any account at our sole discretion, but will make sure that any contractual obligations already made will be honoured. You can at any time close your account by contacting our support team: sales@bmesgroup.com with subject title, CANCEL ACCOUNT.
4. Privacy policy
You acknowledge and accept that we collect personal information about you when you sign up to become a customer on our website. Some of this information is required by law, and other information is collected by us in order to offer you a superior service. One such other piece of information is called cookies, and is a small piece of data needed to able to provide you with a better and faster experience. By using our website, you are consenting to our use of cookies for the purposes outlined here, and this in order to provide you with a fully functional experience. All personal information collected is protected according to the (GDPR) Data Protection Act of EU. We will not collect more data than we have to in order to administer your account and what is required by law. We will make sure to limit access to your personal data only to employees who need to have access in order to execute their duties or be of service to you. All employees who handle personal information have received the appropriate training in order to protect your data. Marketing related communication from us to you, will only be sent if you have opted in to receive it. Your personal details will not be shared with third parties without your acceptance. We do reserve the right to disclose your data if so required by law, or in order to comply with requirements from the regulatory authorities or if we suspect violations of these terms and conditions, such as fraud and / or any other unlawful behaviour.
5. AML - Anti-Money Laundering
We have an obligation to comply with the Prevention of Money Laundering Act of Malta and other related, relevant legislation and guidelines. It is illegal for us to make deposits on our website with funds from ill-gotten means. We monitor and check all transactions on our website in order to uncover potential anti money laundering activity. If we find or suspect suspicious activity, we have an obligation to report such activity to the relevant authorities. We reserve the right to temporarily suspend and make unavailable access to the the account during such a submission or investigation.
6. Complaints
You can submit a complaint to our support team 24 hours a day via our contact us page or by sending an email to sales@bmesgroup.com with subject line COMPLAINTS. We will acknowledge your submission within one working day and make sure we investigate diligently the problems you might have encountered while using our website. The final outcome of a complaint will be communicated to you no later than 20 days after you initiated the complaint.
